Navigating the Challenges of Submitting an L1-B Petition
Submitting an L1B visa petition can be a complex process, rife with challenges that require meticulous planning and execution. This is a story about the case of our clients, involving Chinese nationals transferring to the United States under the L1B visa category, and our objective is to underscore some of the common obstacles faced during this process. However, learning from our experience you too can be successful in preparing a winning L1B petition and we’ll offer practical solutions to overcome the hurdles within.
First, some context: The L1B visa allows U.S. employers to transfer employees with specialized knowledge from one of their foreign offices to a U.S. office. In this case, the petition aimed to transfer specialised employees from a Chinese organisation to its U.S. affiliate. The L1B petition process was initiated after detailed discussions and agreements, but several challenges emerged along the way.
One of the primary obstacles that can arise in cases such as these is a language barrier. In a project where clients were non-native English speakers, this can lead to significant miscommunications and delays. This issue can derail the entire process if not managed properly. From our years of interaction with foreign clients, we strategize to avoid this situation before it becomes a problem by simplifying the communication process. To address language barriers, we recommend using simple, clear language and avoiding technical jargon. Try breaking down requests into smaller, manageable parts. Utilize reliable translation services to ensure accurate communication and confirm understanding after each major communication to prevent misunderstandings.
Miscommunication, exacerbated by different time zones, can also lead to missed meetings and delays in gathering necessary information. This is a common issue in international transfers where coordination across continents is required. We mitigated all delays and strategized to schedule meetings considering both time zones and confirmed the timing 12 hours in advance. We do so by using project management tools to track progress and deadlines. We recommend establishing a clear communication protocol with the client, specifying preferred methods and times for communication. And most importantly, regularly updating the client on progress and upcoming requirements to maintain engagement.
Here’s the biggest challenge people face: insufficient research. Insufficient research before invoicing leads to unanticipated complexities during the process. This oversight can affect the quality of service and financial viability of the project. We made sure to conduct comprehensive research on the client's needs and the scope of work before quoting a price. We clearly outlined the services to be provided and ensure the client understands and agrees to them. Finally, factored in potential challenges and additional work that may arise, and included these considerations in a holistic, well researched, and thorough pricing structure.
Steps in the L1B Petition Process
1. Gather Detailed Information
The first step is to collect all relevant information about the job roles, duties, and the specialized knowledge required. This involves:
- Developing detailed questionnaires to gather information on job responsibilities and the skills of the applicants.
- Ensuring the applicants’ resumes are updated and accurately reflect their specialized knowledge.
2. Complete the Form I-129
The next step is filling out the Form I-129, Petition for a Nonimmigrant Worker, along with the L Supplement. This requires:
- Accurate and complete information on the employer, the job position, and the beneficiary.
- A detailed description of the specialized knowledge and how it benefits the U.S. office.
3. Prepare Supporting Documentation
Supporting documentation is crucial for validating the petition. This includes:
- Recommendation letters from the U.S. employer, previous employer, and work colleagues.
- Evidence of the relationship between the U.S. and foreign offices.
- Proof of the specialized knowledge possessed by the applicants.
4. Review and Submit the Petition
Before submission:
- Review the petition thoroughly to ensure all information is accurate and complete.
- Address any potential issues or gaps in the documentation.
Navigating the complexities of the L1B process requires diligence, attention to detail, and proactive problem-solving to ensure a smooth transition for specialized employees into the U.S. market and above all, the courage to not just jump in headfirst but also, be courageous enough to find solutions. That is our mission statement through and through at Blackstone.
